Poker ist vor allem im europäischen Raum nur ein vager Begriff und hat erst im letzten Jahrzehnt an Bekanntheit gewonnen. Es gibt teilweise kaum Regulierung und noch weniger exakte Gesetze in diesem Bereich und wenn, dann häufig konfus oder zumindest im Widerspruch zur EU-Gesetzgebung. Gesetzlich sind vor allem die Richtlinien und das Steuerrecht von Bedeutung. In Österreich behandelt die Gesetzgebung vor allem herkömmliches Glücksspiel und Lotterien. Es entsteht aber eine Problematik bei Onlinepoker, wo sich Anbieter und Spieler oft in verschiedenen Ländern befinden. Den Beruf des Pokerprofis betreffend liegt das Hauptaugenmerk der Arbeit nicht nur auf Casinos und dem Bundesministerium für Finanzen, sondern besonders auf der Situation des Spielers. Ziel ist es, festzustellen ob dieser Beruf in Österreich überhaupt möglich ist und unter welchen Bedingen dieser ausgeübt werden kann. Neben der rechtlichen Situation betrifft das auch Themen wie Einkommen, Pensionsvorsorge oder Sozialversicherung. Die Arbeit behandelt somit die Bereiche Gesetzgebung, Steuern und Einkommen beim Pokern in Österreich und die Sicht des Anbieters, des Staates und des Spielers darauf.

The popularity of poker in Europe has increased, especially in the recent decade. However, there are only few regulations or laws regarding that topic and if then they are rather confusing or in conflict with laws of the European Union. From a legal point this concerns mainly guidelines and the fiscal law. For instance, Austria has only laws for gambling in general including the national lottery. Naturally, this leads to difficulties with online poker where provider and players are often located in different countries. Professional poker is the main topic and here not only casinos and the revenue office but the situation of the player in particular. Goal of this thesis is to evaluate if and how it is possible to play poker for a living in Austria. In addition to legality this includes areas like income, retirement or social security. This thesis covers the topics legislation, taxation and income of poker in Austria as well as the point of view of the player, the provider and the government.
