Die vorliegende Bachelorarbeit setzt sich mit der Thematik Gründungsprozess sowohl im Theoretischen als auch im Praktischen auseinander. Ziel der Arbeit ist die Betrachtung der Machbarkeit eines Unternehmens in der Planungsphase hinsichtlich der rechtlichen und wirtschaftlichen
Aspekte. Das Unternehmen betreibt eine Salzwasser-Aquakultur, was den aktuellen Entwicklungen in der Lebensmittelbranche hinsichtlich Gesundheit, Regionalität und Nachhaltigkeit entspricht.
Aufbauend auf die theoretische Erarbeitung relevanter Faktoren, werden diese im praktischen
Teil mittels einer Machbarkeitsstudie aufgearbeitet, an das Unternehmen angepasst und abschließend analysiert und Lösungen für die relevanten Faktoren präsentiert. Im rechtlichen Aspekt erfolgt eine Auseinandersetzung unter anderem mit der Rechtsform und etwaigen Genehmigungspflichten. Im wirtschaftlichen Teil wird eine SWOT-Analyse durchgeführt, die Organisationsform des Unternehmens und aquakulturspezifische Punkte, wie die gewählte Fischart und
deren Besatzdichte, werden besprochen. Außerdem werden finanzielle Faktoren, wie die Investitions-, Deckungsbeitragsrechnung und eine Break-Even-Analyse, behandelt und die entsprechenden Rechnungen durchgeführt. Die Machbarkeit wird als durchführbar eingestuft, mit Einschränkungen im Bereich des Baurechts und der Finanzierung, die in der Umsetzungsphase abgeklärt werden können.

This bachelor thesis deals with the foundation process both in theory and in practice. The aim of
the work is the consideration of the feasibility of a company in the planning phase with regard to
the legal and economic aspects. The company operates a saltwater aquaculture, which corresponds to the current developments in the food industry regarding health, regionality and sustainability.
Based on the theoretical elaboration of relevant factors, these are examined in the practical part
by means of a feasibility study. These factors are adjusted to the company, analysed and finally
solutions for the relevant factors are presented. The legal aspect deals with the legal form of the
company and possible obligations to obtain a license. In the economic aspect, on the one hand,
areas such as the SWOT analysis, the organizational form and aquaculture-specific points are
addressed, such as the selected fish species and corresponding stocking density. On the other
hand, financial topics like investment calculation, contribution margin calculation and a break-even analysis are discussed, and the corresponding calculations are carried out. The feasibility
is classified as feasible, with restrictions in building law and financing, which can be clarified in
the implementation phase.
