Diese Forschungsarbeit widmet sich dem seit 01.07.2018 in Kraft getretenen 2. Erwachsenenschutzgesetz, welches durch eine enge Zusammenarbeit mit Betroffenen gestaltet wurde. Das Wesentliche dieses neuen Gesetzes ist die Erhaltung der größtmöglichen Autonomie von psychisch erkrankten Personen und Menschen mit einer vergleichbaren Beeinträchtigung, die in ihrer Entscheidungsfähigkeit eingeschränkt sind. Neben allgemeinen Informationen zum neuen Modell, sollen auch die Gründe für die Reform, nämlich den Anstieg der Sachwalterschaftszahlen, fehlendes Fachpersonal und unzeitgemäße Terminologie, und die zentralen Änderungen von der alten Sachwalterschaft zum neuen 2. Erwachsenenschutzrecht erläutert werden. Es soll ein guter Einblick in die neue Gesetzeslage und in die wesentlichen Punkte, wie etwa die Stärkung der Autonomie, aber auch die Erhaltung der Handlungsfähigkeit, die Sicherheitsmechanismen des Modells und die Miteinbeziehung von Verwandten und Bekannten in Entscheidungen gegeben werden. |

This thesis is focused on The Second Protection of Adults Act which entered into force on the 2018.07.01 and which was revised over with the close involvement of individuals concerned themselves. The essential part of this new law is to maintain the greatest possible autonomy of mentally ill persons and people with a comparable impact who are limited in their ability to make decisions. Besides the general information about the new model one of the reasons for the reform was the increasing number of guardianships, also the lack of qualified personnel and the untimely terminology. Also the central changes from the old guardianship to The Second Protection of Adults Acts will be explained. The work also provides a good insight into the new legal situation and the key points, such as strengthening of autonomy but furthermore maintaining the capacity to act, the safety mechanisms of the model and above all gives relatives and acquaintances more power of representation. The scientific work will concentrate on the following research questions: What benefit does The Second Protection of Adults Act bring? To what extent was the old guardianship reformed? What are the key points in the new law? What are the advantages and disadvantages in the political and social context? The use of legal texts and a literary analysis allowed answering these questions. |
